These Terms and Conditions ("Terms") govern your access to and use of our website at www.soundformovement.com (the "Site") and any related services (collectively, the "Services"). By using our Site or Services, you agree to these Terms. If you do not agree, discontinue use immediately.
2. Acceptance of Terms
Your continued use of the Site or Services signifies that you accept and are bound by these Terms. If you do not wish to be bound, do not use the Site or Services.
3. License to Use the Services
3.1. Ownership of Licensed Materials
The "Licensed Materials," including images, audio files, video files, and any textual content, are owned by or licensed to Sound for Movement. These materials are protected by copyright, trademark, and other intellectual property laws. You do not gain any ownership interest in the Licensed Materials.
3.2. Scope of License
Subject to these Terms, Sound for Movement grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Licensed Materials for commercial, personal, and educational uses.
3.3. Restrictions
You must not modify, redistribute, sell, lease, or otherwise exploit the Licensed Materials beyond the scope of your specific license (as described in Section 6) without explicit written permission from Sound for Movement.
4. Digital Downloads and Streaming
4.1. Free Access
You may stream or download tracks from the Site, subject to these Terms.
Certain actions (e.g., downloading files) require you to create an account and remain logged in.
4.2. Account Creation
You are responsible for maintaining the confidentiality of your account credentials and any activities that occur under your account.
5. Educational Materials
Any free educational content is for personal, educational use only. Such materials remain subject to the intellectual property protections mentioned above and may not be shared or used for commercial purposes.
6. Licensing Options
We offer various licensing options to accommodate different needs and uses of our Licensed Materials. For large productions, motion picture companies, or major streaming platforms, please contact us directly for specialized support.
6.1. Choreographers, Dance Companies, and Filmmakers
$150/year
- Complete licensing solution for performances, media, and commercial use
- Unlimited Licensing
- Covers all performances, showings, and festivals
- Covers any web or social media usage
- Covers commercial license
6.2. Education Program 1
$250/year
- For education programs with fewer than ten full-time faculty
- Includes everything in the Choreographers, Dance Companies, and Filmmakers subscription
- Covers all students, faculty, and staff licensing
- Good for the lifetime of a project
6.3. Education Program 2
$500/year
- For education programs with ten or more full-time faculty
- Includes everything in the Choreographers, Dance Companies, and Filmmakers subscription
- Covers all students, faculty, and staff licensing
- Good for the lifetime of a project
6.4. Limited License
$100 per track
- Perfect for single venue performances and festivals
- Covers limited performance runs at a single venue
- Covers festivals, showings, and screenings
- For Dance, Film, and other media types
6.5. Extended License
$300 per track
- Comprehensive licensing for the entire project lifecycle
- Covers licensed track(s) in perpetuity
- Licensed track(s) good for a single project lifecycle
- For Dance, Film, and other media types
6.6. Student License
$25 per track
- Special pricing for currently enrolled students
- Same coverage as the Limited License, at 75% off
- Recommended for students only
- Covers students currently enrolled in K-12, undergraduate, graduate, or similar educational programs
6.7. Automatic Renewals
Annual Subscriptions renew automatically unless canceled before the renewal date.
You can manage or cancel your subscription through your account settings.
6.8. Licensing Process
After purchasing a subscription and logging in, a "Licensing Form" button will appear on the licensing page.
Complete and submit the form to receive your license instantly via email.
You can save and share the license as needed for your records and with venues that require proof of licensed music.
7. Payments and Transactions
7.1. General
Subscription fees or one-time license fees are clearly indicated at the time of purchase.
All payment and billing matters are handled via integrated payment options (e.g., Stripe).
8. User Conduct and Obligations
8.1. Prohibited Activities
You agree not to use the Site or Services for any unlawful purpose or in a manner that infringes the rights of others.
You may not disable or circumvent security-related features or attempt to gain unauthorized access to any part of the Site or Services.
8.2. Compliance with Laws
You are responsible for ensuring that your use of the Site, Services, and Licensed Materials complies with all applicable laws and regulations.
9. Disclaimer and Limitation of Liability
9.1. Disclaimer of Warranties
The Site, Services, and Licensed Materials are provided "as is" without warranties of any kind, either express or implied.
9.2. Limitation of Liability
To the extent permitted by law, Sound for Movement will not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Site, Services, or Licensed Materials.
10. Indemnification
You agree to indemnify, defend, and hold harmless Sound for Movement, its licensors, and affiliates from any claim or demand arising out of or related to your violation of these Terms or your misuse of the Licensed Materials.
11. Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on the Site with an updated "Last Updated" date. Continuing to use the Site after any such updates become effective indicates your acceptance of the new Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Sound for Movement operates, without regard to conflict-of-law principles.
